Lelang Kayu Hasil Operasi Diminta Transparan


JAKARTA-Operasi bertubi-tubi yang dilakukan Mabes Polri terhadap pembalakan liar (illegal logging) masih menyisakan pekerjaan rumah. Kalangan anggota DPR meminta proses lelang terhadap jutaan kayu sitaaan dilakukan secara transparan. Selain itu, Menkopolhukam diminta tegas terhadap oknum aparat lintas departemen yang diduga menjadi backing cukong-cukong kayu.


“Kinerja operasinya bagus, tapi pasca operasi juga harus tetap bisa dipertanggungjawabkan,” ujar anggota Komisi 1 DPR Mutammimul Ula di Jakarta kemarin (30/03). Saran itu juga sempat ditanyakan saat Komisi 1 menggelar rapat kerja dengan jajaran Kementrian Polhukam yang khusus membahas illegal logging.


Menurut Tamim, peluang terjadinya pelanggaran hukum saat pelelangan sama besar dengan pembalakan liar itu sendiri. Dalam laporan resmi Menkopolhukam yang disampaikan pada DPR, dalam dua tahun terakhir negara mencatat berhasil menyelamatkan uang sebanyak Rp 294 miliar dari hasil lelang kayu. Rinciannya, pada tahun 2006 sebesar Rp 209.706.652 dan pada 2007 sebesar Rp 83.428.356.


Kementrian Polhukam juga melaporkan pada 2007, jumlah tindak pidana illegal logging yang ditangani Mabes Polri mencapai 1.749 kasus dengan jumlah tersangka 1.717 orang. Barang bukti berupa kayu tercatat 503.471 meter kubik ditambah kayu batangan sebanyak 405.825 batang.
Secara terpisah Wakil Ketua Komisi 1 DPR Sidharto Danusubroto meminta Menkopolhukam memfasilitasi pembagian kerja antara aparat kepolisian dan aparat Departemen Kehutanan. “Kalau dua instansi itu tidak sinergis, operasi di lapangan akan terbengkalai,”ujar purnawirawan polisi yang pernah bertugas di Interpol itu.


Sidharto mencontohkan, proses penindakan pembalakan liar di Riau. “Ada perbedaan persepsi antara jajaran Dephut dan Polda Riau soal pemberian ijin usaha pemanfaatan hasil hutan tanaman industri, di daerah lain jangan sampai terjadi” katanya.


Khusus untuk Riau, saat ini, Menkopolhukam berusaha memediasi dengan membentuk Tim Penyelesaian Masalah Illegal Logging di Riau (TPM). Tim itu terdiri dari Tim Pengarah (Menkopolhukam Widodo AS dan Menko Perekonomian Boediono) dan Tim Pelaksana (Deputi V Menkopolhukam dan Deputi III Menko Perekonomian).


Politisi PAN M Djunaedi menilai godaan ‘iman’ aparat di lapangan terhadap cukong-cukong kayu sangat besar. “Itu harus diimbangi dengan pemberian tunjangan dan insentif untuk petugas jagawana, polisi hutan dan aparat keamanan lain yang bertugas di hutan-hutan pedalaman,” katanya.(rdl

Greenpeace mendukung Peraturan Daerah Papua tentang larangan ekspor kayu gelondongan. Kebijakan pemerintah Daerah ini mendapatkan dukungan dari LSM lingkungan Greenpeace.

Namun, pada tanggal 17 Maret 2008 di Jayapura, 40 perwakilan industri kehutanan meminta keringanan atas kebijakan yang dibuat Pemda Papua. Hal yang sangat disayangkan oleh Greenpeace adalah permintaan itu didukung oleh pemerintah pusat, melalui Presiden dan Wakil Presiden.

“Pemerintah Daerah Papua memiliki komitmen yang teguh untuk menyelamatkan hutan Papua dan meningkatkan kesejahteraan masyarakatnya, seharusnya pemerintah juga mendukung.” Ujar Bustar Maitar, Juru bicara Greenpece di Jayapura.

Rencana Papua untuk melarang kayu gelondongan dan CPO keluar dari bumi Cendrawasih muncul dari Gubernur Barnabas Suebu di sela konferensi PBB tentang Perubahan Iklim yang berlangsung di Bali.

Suebu menyatakan Papua akan menerbitkan Peraturan Daerah (Perda)tentang Pengelolaan Hutan Berkelanjutan.Larangan ini telah melahirkan Perda yang disahkan oleh DPRD pada Januari 2008. Isi Perda antara lain tentang pelarangan ekspor CPO dan kayu gelondongan dari Papua.

Secara global, laju pennggundulan hutan tropis telah berkontribusi dalam meningkatkan emisi gas rumah kaca sebesar 20%. Indonesia sendiri tercatat sebagai negara dengan penggundulan hutan tercepat versi Guinness Book of Record 2007.

Puncak Jaya Salju Abadi di Papua

Terletak di rangkaian Pegunungan Sudirman, tepatnya di Taman Nasional Laurentz, Papua. Puncak Jaya atau Carstenz Pyramid merupakan salah satu dari tujuh puncak benua (The Seven Summit) versi Reinhold Messner yang menjadi incaran para pendaki gunung dari seantero dunia. Puncak berselimut salju abadi ini adalah puncak tertinggi di Asia Tenggara dan Pasifik. Bukan cuma itu. Salju abadi di Puncak Jaya juga merupakan satu dari tiga padang salju di daerah tropis yang terdapat di dunia, selain Andes di Argentina dan Kilimanjaro di Tanzania.

Puncak Jaya lebih dikenal di seluruh dunia sebagai Carstenz Pyramid (4884 meter). Nama Carstenz diambil dari nama belakang orang Eropa pertama yang melihat salju di puncak gunung tersebut, Jan Carstenz. Konon, Carstenz sempat ditertawakan ketika bercerita di negara asalnya, Belanda, bahwa ia melihat salju di daerah tropis. Nama Puncak Jaya sendiri merupakan pemberian Presiden Soekarno setelah mendapatkan kembali Irian Jaya dari Belanda.

Sejatinya, ada dua versi The Seven Summit, yakni versi Reinhold Messer dan Dick Bass. Meski berselisih paham, keduanya sepakat soal sejumlah puncak dunia seperti Mount Everest (8850 m) dari lempeng benua Asia, Aconcagua (6958 m) dari lempeng benua Amerika Selatan, Mc Kinley/Denali (6193 m) dari lempeng benua Amerika Utara, Kilimanjaro (5894 m) dari lempeng benua Afrika, Elbrus (5641 m) dari lempengan benua Eropa dan Vinson Massif (4897 m) dari lempeng benua Antartika.

Namun mereka berbeda pendapat soal dua puncak gunung yang terletak di lempeng yang sama tetapi di benua yang berbeda. Dalam versi Messer, Puncak Jaya masuk dalam The Seven Summit karena termasuk dalam lempeng Australia meskipun Indonesia masuk dalam benua Asia. Tetapi dalam versi Bass, puncak Kosciuszko-lah (2228 m) di Australia yang masuk kategori tujuh puncak dunia tersebut.

Walau begitu, para pendaki gunung tampaknya lebih tertantang oleh Puncak Jaya karena dikenal mempunyai tingkat kesulitan yang tinggi. Selain medan pendakian berupa dinding granit curam dan batu pijakan yang tajam, letak Puncak Jaya di tengah hutan belantara juga cukup menyulitkan proses prapendakian. Karena terletak sangat dekat dengan garis khatulistiwa, semua pendaki juga harus siap mendaki dalam keadaan hujan terus-menerus. Angin besar bisa muncul dari segala arah. Badai salju mungkin terbit di tepi Puncak Jaya.

Kawasan Puncak Jaya ternyata sempat ditutup untuk turis dan pendaki selama hampir 10 tahun (1995-2005). Setelah dibuka dua tahun lalu, sudah beberapa agen perjalanan menawarkan paket pendakian bagi para pendaki dunia yang ingin menyelesaikan perjalanan The Seven Summit mereka.

Log ban in Indonesia’s Papua appears effective

The environmental group Greenpeace says the ban on log exports in Indonesia’s Papua province has proven successful so far.

The ban was spearheaded by Papua governor Barnabas Suebu last December in an effort to save the region’s remaining rainforests from rampant deforestation.

A Greenpeace spokesman in Indonesia, Bustar Maitar says that the governors of both Papua and West Papua provinces have withstood recent industry pressure to loosen the ban.

He says Governor Suebu this month met with 40 forestry investor representatives who asked him to loosen the regulation, a call backed by Indonesia’s president.

“They asked (the) Governors to reconsider, to reopen again the log exports from Papua to other places in Indonesia because the industry in Java and also Sulawesi, it’s difficult to get the source for furniture and things like that there. But the Governors are still with their commitment to not allow any single logs to be transported outside Papua.”Bustar Maitar says while it’s hard to monitor all logging in Papua,

the forestry industry appears to be abiding by the ban.

The Indonesian government should order the immediate release of nine West Papuan activists arrested for displaying the Morning Star flag (a symbol of West Papuan independence). All charges against them should be dropped.

On March 13, police arrested nine people in Manokwari, West Papua, during a demonstration against a 2007 law banning the display of “separatist” symbols, including the Morning Star flag. One of the nine in custody is reported to be a 16-year-old boy.

Indonesia’s arrest and detention of peaceful activists violates the internationally recognised rights to freedom of expression and assembly.

“Raising a flag at a demonstration is a nonviolent act, but in Indonesia it can land you in prison”, said Elaine Pearson, deputy Asia director at Human Rights Watch. “If Indonesia wants recognition as a rights-respecting nation, it should stop imprisoning people for acts of peaceful expression.”

Peaceful campaigning for self-determination is a right protected by international human rights law, including the International Covenant on Civil and Political Rights, which Indonesia ratified in February 2006.

Major Crackdown On Peaceful Protest In West Papua

West Papua, Tuesday March 25 2008: Yesterday Indonesian Police captured the Chief of Council for West Papua National Authority, Eli Kaiway. He presented himself peacefully under summons for interrogation, and Police arrested him. He is being held at POLRES Manokwari, and now with other detainees, and police have said that he will be charged with Rebellion and spreading hatred against the state “because it is positive that he gave the order for the flagraising,” according to POLRI

The underage political prisoner released now, Silas Carlos Tevez May, has been bailed and given a permit to go to high school, and to stay with his parents. It is still unconfirmed whether or not that constitutes house arrest.

On Wednesday night last week Jack Wanggai was taken by KaploRes Marjuki and 2 other intelligence from custody room to interrogation. We have received clear information and hold grave concerns that Jack was tortured for over two hours from 1030pm West Papua time, to find out who was behind all the uprising.

This was the same treatment meted out on pro democracy activists at the end of Suharto era. Intelligence personnel, led by Marjuki demanded the following answers during Interrogation:

• Who in foreign country is behind these actions and escalation of struggle?

• Who are the bureaucrats in the Indonesian Civil Service in West Papua are behind you?

• Which Academics and Scientists are behind you?

• What built the links with outside movement? Who provided the telephone numbers?

This is another example of Indonesian state terror and intimidation of peaceful West Papuan expression, contrary to Indonesian national regulation PP 77/2007.

On 18th of March Agus Alua, Deputi MRP Frans Wospakrik and Mrs Hana Hikoyabe called on the Indonesian government to release all detainees as this violates provisions of Special Autonomy. (see attached interview with Dr Agus Alua, Cenderawasih pos, 18 March 2008). Do not wait until bloodshed occurs, international observers are needed.

Today, Tuesday March 25th, demonstrations have been held across West Papua in Jayapura, Sorong, Serui, Nabire, Fak Fak, Timika and Biak. Latest information from Sorong is that the Indonesian Military and POLRI have combined forces in an armed military counter insurgency operation against civilian peaceful demonstrators. Two army trucks are patrolling Sorong currently with 2 platoons of KOSTRAD (Strategic Reserve) troops, backed up three 4 wheel drives full of armed military intelligence (SGI), and one police 4wd. All personnel are fully armed with automatic weapons, and are intimidating and causing great concern to the local population as a show of force to prevent people from joining Papua wide peaceful assemblies calling for Referendum. From Yesterday, a 24 hour curfew, on penalty of arbitrary arrest, has been imposed on all centres in West Papua. So far in Sorong, 6 people have been arrested by police and are currently held POLRES Sorong.

Currently in Serui, there is a peaceful gathering of over 100 people, after massive intimidation kept many away. A prayer meeting was held to defuse tension with the military. Whilst the prayer meeting was happening at the home of Wilson Uruwaya (Co-ordinator of West Papua National Authority Serui regency), more than 30 police and intelligence in three trucks, kijang patrols, black (intelligence) kijangs and on ojek (passenger motorbike transports) – all making up a Satuan Kepolisian (SSK or police unit) have been taking up positions outside his home to harass and intimidate people.

The planned demo in Manokwari has been delayed due to a counter action organised by Badan Intelijen Nasional (BIN). HMI (Himpunan Mahasiswa Islam – Islamic Students Association) and GMKI (Gerakan Mahasiswa Kristen Indonesia) were organised by BIN as a diversionary tactic to demonstrate against alleged corruption by Papuan provincial government figure. The groups have been utilised in the past as auxiliaries or militia by BIN and Kopassus, and information received indicated that these groups have either been paid or threatened by intelligence to mobilise. As a result, Papuan people have decided to resume protests in Manokwari when a few less militia are on the streets.

This occurred after rally organisers were terrorised and intimidated across Papua yesterday (Easter Monday), particularly in Serui where a massive show of force was imposed on the local people. A joint security operation has been in force since March 3 and has been conducted by Satuan Khusus Gabungan Intelijen Polisi dan Militer (Joint Special Taskforce of Intelligence, Military and Police – formed with POLRI and the Serui Battalion of the TNI (Indonesian military)) with over security forces on the streets. We have also received confirmed reports that they are training non-Papuans for militia

In Jayapura, more than 30 police forcibly confiscated banners and Morning Star flags, however did not arrest any protestors. Latest information received that 200 people have gathered outside the DPR-D demanding Referendum. The situation is described as tense. More information as it comes to hand.

Outside West Papua, solidarity demonstrations have been held in Canberra, and in Port Vila, the Malvatumauri Council of Chiefs issued a call on the Prime Minister of Vanuatu to put pressure on Indonesia to stop the Repression.. Further demos will be held in Auckland on March 25th.

Despite assurances from the Indonesian government that all peaceful protests would be dealt with legally through the Police, the TNI has become involved in violating the rights of Papuans peacefully expressing their aspirations. There is no place for the use of military forces against legitimate and peaceful actions by civilians. We are gravely concerned at the escalating repression by the Indonesian security forces, and are concerned at military solution to political problems. West Papuan people as a result are calling for the urgent assistance of the international community to immediately form an unimpeded fact finding mission and immediate deployment of international observers, to prevent further genocide from occurring.

More protests will be held until Indonesia listens to the aspirations of the West Papuan people for survival in their own Land.

Serious and grave concerns are held for the potential for torture or ill-treatment of detainees whilst in the hands of the Police and intelligence, as all activists have caused a deal of international humiliation to the Indonesian security forces through creative and peaceful expression of their legitimate aspirations over the past few weeks. Please monitor this situation closely by calling the numbers in Manokwari and Jayapura below to ask why West Papuan people have been arrested and threatened with violence under Suharto era charges. Chief of the Council for West Papua National Authority, Eli Kaiway, has been detained by Indonesian Police in connection with nonviolent protest earlier this month.

Indonesian Police have detained the Chief of Council for the West Papua National Authority, Eli Kaiway, in connection with demonstrations in Papua earlier this month.

Mr Kaiway presented himself under summons for interrogation, and Police arrested him over his alleged role among demonstrators who police say broke rules by raising the Papuan Morning Star flag.

He is being held at the POLRES Manokwari headquarters.

Police say Eli Kaiway will be charged with Rebellion and spreading hatred against the state, claiming he gave the order for the flag raising.

There are now 11 political detainees linked with the Authority in Manokwari at the peaceful rallies nearly three weeks ago.

A West Papua National Authority media release says the student political organisation has grave concerns for some of the detainees who have been tortured in police interrogation.

The Authority notes however that an underage political prisoner, Silas Carlos Tevez May, has been released now on bail.

A delegation of West Papua politicians has blamed Jakarta for the stagnation of special autonomy in Papua and West Papua, saying the two provinces could not properly implement autonomy without guidance from the central government.

“The special autonomy is not just a matter of money,” West Papua chief councilor Jimmy Demianus said, “but rather a political commitment to address problems such as reconciliation, human rights violations, natural resource management, health, poverty, defense and security.”

His comments came after he led the West Papua legislature delegation in separate meetings with the House of Representatives and Regional Representative Council leadership here on Thursday.

The delegation was here to pressure the central government to issue a regulation in lieu of law for the formation of West Papua province.

Jimmy said special autonomy had not been achieved as expected due to an absence of technical and operational guidance from Jakarta.

The law mandates seven government regulations, “but so far only a single regulation (that establishes the Papuan People’s Assembly or MRP) has been issued,” Jimmy said.

“Consequently, both the MRP and the provincial government in Papua and West Papua can not work to make special and provincial bylaws.”

The 2001 law on special autonomy mandates the issuance of at least seven government regulations as technical and operational guidance for reconciliation in Papua, the resolution of human rights abuses, natural resources exploration, population and protection of local cultures.

According to observers, justice and conflict resolution is dependent upon the proper implementation of special autonomy.

Jimmy warned Papua’s problems would become more complex if Jakarta did not facilitate the implementation. In the past five years Papua has been under scrutiny for human rights abuses.

Papuans are confused by the newly proposed fragmentation of the two provinces.

Students and activists in Papua, disappointed with the stagnation and the proposed formation of four new provinces, staged rallies in Jayapura this week, demanding a referendum on self-determination.

They said the proposed formation of new provinces would allow the Indonesian Military to bring in more soldiers and would damage local cultures.

Spacious Papua is three and half times the size of Java and is populated by 2.4 million people, 50 percent of whom are from Sulawesi, Java and Sumatra. It is home to many mining and forestry companies, including U.S.-based PT Freeport Indonesia.

During recent meetings in Jayapura, Governor Barnabas Suebu admitted the government’s progress in addressing social problems and maintaining political stability in the province was less than desirable.

“Despite huge special autonomy funds being allocated over the last seven years, most people are still living in poverty and are uneducated. A bigger part of the funds have been used to finance bureaucracy,” Barnabas said.

Political observers from Cenderawasih University in Abepura, Papua, said the Rp 30 trillion allocated to the two provinces this year would not be spent in the public’s interest in the absence of technical and operational assistance from Jakarta.

Jakarta-RoL– Tim 80 Papua Selatan (Papsel) mendesak pemerintah untuk segera menerbitkan amanat presiden (ampres) pemekaran Propinsi Papua Selatan (PPS) guna mendorong percepatan pembentukan propinsi baru di bagian selatan Papua itu.

“Sebelum hari kebangkitan nasional, kami harapkan restu dari Bapak Presiden agar ampres sudah turun,” kata Jubir Tim Pemekaran Propinsi Papua Selatan (Tim 80) Yoseph Y.Mahuze di Jakarta, Kamis.

Berbicara usai menghadiri pertemuan delegasi Papua Selatan dengan Plt Sekretaris Menko Polhukam Mayjen TNI Romulo R Simbolon, ia mengatakan, seluruh persyaratan pembentukan PPS lengkap dan telah disampaikan kepada MRP (Majelis Rakyat Papua), DPRD dan Gubernur Papua.

“Namun, hingga kini pembentukan PPS belum juga disepakati. Karena itu, kami mendesak agar pemerintah segera menerbitkan ampres hingga pada tahun ini sudah dapat dilaksanakan Pilkada di PPS,” kata Yoseph.

Semua persyaratan pembentukan PPS telah diproses di Komisi II DPR bahkan telah ditetapkan di sidang paripurna menjadi RUU Inisiatif Dewan tentang pembentukan PPS yang murni berdasar aspirasi masyarakat bukan kepentingan politik segelintir orang, atau tokoh masyarakat tertentu.

Sebelumnya, delegasi Papua Selatan yang terdiri dari elemen di Kabupaten Merauke, Mappi, Asmat dan Boven Digul, juga telah mendatangi Departemen Dalam Negeri terkait pembentukan PPS.

PPS, tambah Yoseph, merupakan wilayah di bagian selatan Papua yang berbatasan langsung dengan lima negara seperti Australia, Timor Leste, Selandia Baru, Papua Nugini dan Fiji. “Dengan terbentuknya PPS, maka itu akan menjadi propinsi terdepan di perbatasan yang membingkai Negara Kesatuan Republik Indonesia (NKRI), jadi tidak ada alasan lagi untuk menunda,” ujarnya.

Menanggapi itu, Sekretaris Kementerian Koordinator Politik, Hukum dan Keamanan (Polhukam) Mayjen TNI Romulo R Simbolon mengatakan, pemerintah akan mengedepankan penyelesaian berdasar prinsip dan aturan negara demokratis sesuai hukum dan perundang-undangan yang berlaku. antara/mim
